Two months later, a new executive order replaced the initial directive, providing additional justification for controlling the arrival of multiple immigrant classes from primarily Muslim-majority countries. Trump modified the list of countries and immigrants affected throughout his presidency.
The ban remained a source of controversy from beginning to end. Opponents argued it discriminated based on nationality and religion under the 1965 Immigration and Nationality Act and the First Amendment’s Establishment Clause. Its supporters argued with similar vigor that Trump’s decree fell within the plenary power granted to a president while asserting that it focused on addressing the threat posed by radical Islamic terrorism—and not on punishing Muslims.
The ban most notably affected Iran, Libya, North Korea, Somalia, Syria, Venezuela, and Yemen. Trump imposed additional restrictions on Eritrea, Kyrgyzstan, Myanmar, Nigeria, and Tanzania in 2020.
