In a landmark decision, the Supreme Court ruled that LGBT workers are protected from workplace discrimination under Title VII of the 1964 Civil Rights Act.

The Civil Rights Act already prohibited discrimination on the basis of sex. Social conservatives tried to argue that Congress couldn’t have foreseen the definition of the word sex to evolve to encompass an individual’s sexual orientation or gender identity.

Fox News reports:

“Ours is a society of written laws. Judges are not free to overlook plain statutory commands on the strength of nothing more than suppositions about intentions or guesswork about expectations. In Title VII, Congress adopted broad language making it illegal for an employer to rely on an employee’s sex when deciding to fire that employee,” said the court’s opinion, written by Justice Neil Gorsuch.

“We do not hesitate to recognize today a necessary consequence of that legislative choice: An employer who fires an individual merely for being gay or transgender defies the law.”

  1. Hooray for the Supreme Court decision! We are all Americans who live under the rule of law and this covers all men and women regardless of how you see yourself or a specific lifestyle. There should never be any decision toward “special interests” regardless of race or lifestyle status.

    2. Can you biologically prove a man is a woman or vice versa? Or that biologically there are more than two sexes but somehow over the course of 2 million years mankind missed the third until now? The Book of Genesis informs us that our Creator created a Man and a Woman. Nowhere was there any mention of a physical transformation of a man into a woman Anyone who has a penis and has a notion that he is a woman is at the very least confused and in need of pyschological consuling. Of course if you graduated from university during the past two decades it’s understandable if you think otherwise.

  4. It is reminiscent of what the Supreme Judicial Court of Massachusetts did 15 years ago when it had neither statutory language nor legislative history to go on. It legislated from the bench. While I wouldn’t decry the results under an equal protection argument, I would like to remind the judiciary that it is neither the arbiter of taste nor morality. Certainly, what the Court did Congress could have done and perhaps should have done, but it didn’t. From my perspective, under our Constitution, this is a usurpation of an Article I power. I would like to also remind the Court that the words sex and gender are not the same. Sex is biological, gender is grammatical.

  7. There is nothing to get in a huff about. This is simply stating what already exists in Law for other categories. You can still fire an LBGTQXYZ123 if needed. Just not simply on that basis alone. If Tort reform ever gets passed properly, the Democrat Party will lose a huge funding source and frivolous lawsuits will be more challenging to bring to court from all the “special” people with their sense of grievance and entitlement.

  11. How totally disappointing as the Supreme Court has now placed the last nail in the coffin of a representative republic. This has nothing to do with whether LTGB individuals should be covered by Title 7, for that is clearly an issue for the people to decide through their elected Representatives. What the Supreme Court has done is to give unto itself the ability to rewrite and reinterpret the clear and plain language of any legislation Congress passes.

    In 1964 LTGB was not only not a thing, sex change operations had never been done and transgenderism was considered a mental illness. The word SEX in Title 7 in it common and legal usage at the time meant biological sex, period. The Supreme Court’s decision and claim that the Congress used the word Sex in a broad sense is total and utter nonsense with no basis in fact. Homosexuality was a thing and would be covered by the plain understanding of the word..

  14. I don’t understand why there should be a law like this. If you go to work and do your job everyday like everybody else, you don’t have to be worried. But if you make it difficult for everyone else to work with you, you are not a valuable member of the team. The boss has the final say, don’t take that away from them.

  15. I am worried that this decision will require religious institutions to keep teachers and other employees who gay marry. This has happened twice in our state (WA)…catholic schools required their teachers to sign a contract that said if they were to give scandal or commit sin that causes a scandal, then they would be terminated. It happened twice in 5 years that catholic HS teachers gay married and were fired for getting married to one of the same sex. This will cause numerous lawsuits against catholic schools, so get ready by crafting pre-hire contracts that meet the law but prevent the catholic church from sanctioning gay marriage. The LBGT activists will try to make sure that you care and that you capitulate.
