A top aide to Hillary Clinton says she would have won the presidential election if a new Hulu documentary about her had come out in 2016, even though one of her top issues was a promise to make it illegal for Americans to produce films about presidential candidates.
“There’s just so much she and we can do,” Phillip Reines told MSNBC’s “Morning Joe.” “If we had this documentary the day before Election Day in 2016, she would be president right now.”
Reines was referring to filmmaker Nanette Burnstein’s four-part documentary, “Hillary,” now airing on Hulu.
But Clinton spent much of the 2016 election vowing to overturn the Supreme Court’s 2010 ruling in “Citizens United v. FEC,” which made such documentaries legal.
In 2008 the conservative group Citizens United produced a documentary film about Clinton that criticized her liberal record.
Even though the film did not advocate a vote for or against Clinton, the Federal Election Commission tried to ban the film, and any materials on political candidates, claiming they were election communications.
Citizens United sued to allow the film to be screened, taking the case all the way to the Supreme Court.
In that case, the federal government’s lawyers argued that campaign finance laws give federal authorities the power to ban and even confiscate films and books that mention candidates for political office.
Clinton vowed that if elected, she would appoint Supreme Court nominees who would overturn that ruling, allowing documentaries on politicians like Clinton to be banned.
But Reines’ comments make it clear, that police power extends only to films critical of Clinton, making it also clear how close Americans are to be prosecuted and even jailed for their political opinions.
