President Joe Biden is circumventing the authority of Congress by implementing European Union directives related to “climate” and “social justice” on American employers, prompting criticism from members of Congress.
U.S. Senator Tim Scott (R-S.C.), who serves as the Ranking Member of the Senate Committee on Banking, Housing, and Urban Affairs, and Congressman James Comer (R-KY), the Chairman of the House Committee on Oversight and Accountability, have now called upon the Biden administration to clarify “its involvement in facilitating the European Union’s endeavors to impose its progressive climate agenda on American corporations.”
Expressing their profound concerns, Scott and Comer assert that U.S. government agencies under the Biden administration are either tacitly permitting foreign entities to regulate American corporations or actively evading the U.S. regulatory process by collaborating with foreign governments to dictate climate and economic policies to American companies.
In their letters addressed to Treasury Secretary Janet Yellen and Securities and Exchange Commission Chairman Gary Gensler, Scott and Comer disclose:
Between 2021 and 2023, representatives from Treasury and independent U.S. regulatory agencies met with E.U. officials on multiple occasions to discuss “ongoing E.U. and U.S. cooperation” on climate and other sustainability related financial disclosures.
Following one such meeting in October 2021, the U.S. and E.U. issued a joint statement indicating that the E.U. and SEC were engaged in “bilateral technical-level exchanges on sustainability-related disclosures” while the SEC was developing rule proposals addressing disclosures around climate risk.
In addition, after recent such meetings in July 2022 and February 2023, the U.S. and E.U. issued joint statements elaborating that, “E.U. and U.S. participants agreed to continue the bilateral exchange on sustainability-related disclosures and their engagement in international fora, including on standards being developed by the International Sustainability Standards Board.”
Congress did not authorize these measures, which defy America’s national sovereignty and amount to what critics call “regulation without representation.”
Scott and Comer report they “rebuked the agencies for circumventing America’s elected representatives by purportedly coordinating with the E.U. to advance the international application of European climate-related disclosure policies, as well as labor and social justice initiatives.”
The pair “emphasized that these policies would implement onerous requirements that would harm a broad range of U.S. businesses and weaken U.S. capital markets.”
“Any such efforts to advance the E.U.’s ESG agenda over the interests of the U.S. and American companies would be an alarming development and a significant deviation from historical practices. Furthermore, shifting to an E.U.-style climate regulatory regime in the U.S. would materially and unnecessarily harm our nation’s oil and gas sector, agriculture sector, and our preeminent capital markets,” wrote Scott and Comer.
The pair are demanding Treasury and the SEC turn over documents on the scheme, ahead of possible hearings on the matter.
And biden will keep this up unless challenged in courts or the spineless bastards in Congress get a pair!
