Lt. Col. Stuart Scheller, who went viral after posting a video criticizing the Biden Administration’s top generals over their lack of accountability during the Afghan withdrawal, has reportedly now been placed behind bars and is awaiting trial.
As Fox News reports:
“All our son did is ask the questions that everybody was asking themselves, but they were too scared to speak out loud,” Scheller’s father, Stu Scheller Sr., told Task & Purpose. “He was asking for accountability. In fact, I think he even asked for an apology that we made mistakes, but they couldn’t do that, which is mind-blowing.”
Scheller first rose to internet stardom by posting a video to Facebook blasting military leaders for the U.S. withdrawal from Afghanistan, questioning their command decisions on the events leading up to and during the final evacuation effort.
Scheller would go on to release several more videos, generating praise and controversy while drawing the ire of military leadership. Eventually, he was told by superiors to stop posting to social media altogether, an order he immediately ignored by posting about the gag order.

Scheller is “currently in pre-trial confinement,” a spokesperson for Training and Education Command said of the officer’s status.
The time and date of his hearing have not yet been released to the public.

You apparently know nothing of the military. “They” are not separate or above the law, but the Uniform Code of Military Justice (UCMJ) is the set of laws that governs the military. In joining the military, you give up certain rights and are held to a much higher standard of conduct than civilians are. One of those strictures is that commissioned officers are prohibited from speaking disparagingly of the chain of command, including the civilian portion, specifically the Secretary of Defense and the President. To do otherwise is to compromise the entire structure of the military and the sacred concept of civilian control over the military.
Scheller knew this, and violated it. Had he resigned his commission, he would have had the same First Amendment rights as everyone else; remaining in the military and speaking out, he did not. He deliberately broke the law, and must pay the consequences. Not everything that is legal is right, and not everything that is right is legal. With only 17 years in, he is throwing away his military pension and may very well lose his freedom to speak the truth. I applaud his courage.
While you have a point you are also missing that this was done by many under the trump administration most notably vindman. Where was the lockups where were the trials? Oh when its attacking a Republican leadership they are hailed as heroes and Patriots and given whistleblower protections even though they dont qualify for it under the law. All this about First Amendment Rights may (or at least was) true, but when you join the military – and no one is forced into the draft anymore – you give up, or forego, some of those rights for the sake of military unity and discipline. A military unit cannot be effective if everyone does their own thing. If you feel that your First Amendment rights are more important than your military position, walk over the Personal Office and put in your papers. Sounds like this gentleman had every opportunity to do that, or follow orders, as he would expect the men under him to do.
If you got too vocal criticizing the decisions of the CEO of your company you would be fired. Because the security implications of your position as a military officer are much greater protecting you, the citizens of this country, so is the discipline.
