Gun owners and pro-gun groups are rushing to stop a new proposed Biden administration rule which would virtually outlaw homemade firearms.
Not only is the proposed 100-page rule banning homemade firearms unconstitutional on its face, pro-gun groups say the rule is so vague it seems designed to act as a blanket gun ban, allowing the Biden administration to ban and confiscate other firearms without even a vote of Congress.
“If the ATF’s proposed rules redefining what is a firearm and redefining what is a pistol-brace become final rules, it means the Executive Branch – through the Bureau of Alcohol, Tobacco, Firearms and Explosives – can by fiat rewrite the laws Congress passes and even disregard the Constitution itself,” says noted conservative activist Richard Viguerie.
According to Viguerie, the proposed rule would:
Broadly redefine “firearm frame or receiver” and “frame or receiver” to expand the number and types of items that ATF would consider regulated firearms
Amend ATF’s definitions of “firearm” and “gunsmith” to give the federal government more control over guns, gun owners, and those who provide critical services
Codify new definitions of terms such as “complete weapon,” “complete muffler or silencer device,” “privately made firearm,” and “readily” for purposes of law enforcement and prosecution and put people at much greater legal risk
Radically change ATF’s regulations on firearm marking/engraving and recordkeeping
Allow the ATF to grant itself legal authority to issue new anti-2A rules and regulations outside of the Administrative Procedures Act regulatory process
Gun Owners of American and the Gun Owners Foundation were among the groups submitting comments to the ATF’s “Proposed Rulemaking” public comment period.
“The Proposed Rule constitutes a gross overreach by ATF, purporting to greatly expand the arbitrary powers wielded by the agency via bureaucratic fiat rather than congressional authorization, to the detriment of the firearms industry and gun owners nationwide,” GOA said in a press release.
“Nearly every aspect of the Proposed Rule is either arbitrary and capricious, in excess of the agency’s jurisdiction, or in conflict with either statute or constitutional right. Often, it is all of the above. Numerous times, the Proposed Rule purports to blatantly rewrite federal law to suit ATF’s agenda,” said GOA.
“Nearly a dozen times, the Proposed Rule sets out unclear, ill-defined, and ambiguous multi-part tests and standards, each as malleable as mercury, and which seem carefully designed to provide minimum clarity to gun owners and the industry while preserving maximum flexibility to the agency to act based on impulse and whim,” said GOA.

They’ve already ‘picked off’ our rights, but they will appear to be compiling (Or fabricating…) more justifications to do so in order to compel Americans to ‘join’ their campaign to make us safe and secure, while they’re releasing tens of thousands of dangerous convicts and gang members into our cities. It’s time to clean house, and install a Constitutional Government that will abide by their limitations, and accept their responsibilities under our charter.

We the people need to stand together. And NEVER let anyone outside your family circle know what guns that you have or where they are. It’s show time. Let the lawsuits begin….ATF overreach is legendary and needs to be reigned in. The 2nd Amendment is very clear and this violates every bit of it. Their are PLENTY of laws on the books if these morons would enforce those. Then if the Judiciary would follow thru and not let the repeat offenders out…but they just keep doing it. The Spirit of the 2nd Amendment is clear. How that measure is applied is under ‘review’ by our leadership. Remember that our Bill of Rights was ratified before the government operated F-16s, Abrams Tanks and Computer Algorithms. They have the capability to wipe out our entire population with the push of a button. That is why it is VERY important to install a government which will abide by our Constitution, and accept their limitation of powers. Once these tyrants start to ‘editorialize’ their purpose, and bolster their poll numbers by appealing to segments of the population in order to compile an Amen Corner of dependent acolytes, that should be a warning to Americans to commence the process of implementing our Bill of Rights, starting with the first two Amendments.
Every gun owner needs to sue biden and ATF AT ONCE TO FILL THE COURT UP.
