Americans planning to travel abroad don’t need to identify which gender they are on their passports according to a new Biden administration rule announced on Wednesday.
The interim policy removes the previous requirement that forced transgender people to provide supporting documentation from a physician that they had undergone a gender transition.
“You can now select the gender you would like printed on your U.S. passport, even if the gender you select does not match the gender on your supporting documentation such as a birth certificate, previous passport, or state ID,” the State Department announced. “We no longer require medical certification to change the gender marker on your U.S. passport.”
New or current passport holders have the ability to select their preferred gender marker on new applications. “You can select “M” or “F” which are the gender markers currently available,” the statement went on. “We are working to add a gender marker for non-binary, intersex, and gender non-conforming persons as soon as possible.”
The new rule is the first substantial change to federal passport policy when the Obama administration amended the rules to allow transgender people to update their documentation post-transition in 2010.
By the end of the year, non-binary identifying individuals are expected to be able to use an “X” gender marker, rather than identifying as male or female.
Currently, twenty states and Washington, D.C. are issuing driver’s licenses and state IDs with “X” gender markers. Illinois, Indiana, and New York have passed legislation to launch gender-neutral IDs in the near future.
The ACLU calls the Biden administration’s announcement a “victory for trans, non-binary and intersex people who have long sought accurate federal IDs.”

If the gender on a person’s passport need not be factual, then why should a passport have that information? A passport should contain only factual information, not what the person desires that it to contain.
