A federal judge issued a ruling on Wednesday in the state of Louisiana that stopped the Biden administration from unwinding the Title 42 border policy.

As The Wall Street Journal reports:

WASHINGTON—A federal judge in Louisiana has issued a temporary restraining order against the Biden administration forbidding it from moving ahead with its plan to end Title 42, the pandemic-era border policy.

Judge Robert R. Summerhays, of the Western District of Louisiana, issued a temporary restraining order against the Biden administration on Wednesday after signaling his intention to do so two days earlier.

The Biden administration had been on track to end the policy on May 23, a decision that has come under intense criticism from Republicans and some vulnerable Democrats up for re-election this year.

The order prohibits the Department of Homeland Security from taking steps to begin its wind-down of Title 42, such as opting to process more migrants using normal immigration channels ahead of May 23. The order doesn’t prohibit the administration from ending Title 42 on that date, though the judge, who was appointed by President Donald Trump, has set a hearing for a longer-lasting prohibition known as an injunction.

When asked about the ruling an official for the Biden administration reportedly said that the administration would comply but strongly disagreed with the ruling in question.

  1. Rather than immigration go back to what it was pre-Covid pandemic, I think that keeping Title 42 should be kept in place. The people currently waiting to get into the U.S. via filling out the proper papers will wait years before they can come. So, it shouldn’t be any different for those who have yet to file the required forms.
