President Biden officially unveiled his new executive orders on gun control Thursday, which include an attempt to stop so-called ‘ghost’ guns, a ban on handgun braces, and a model for state-level ‘red flag’ laws.
During the announcement, Biden claimed that gun violence in America was a ‘public health crisis and that, referring to the second amendment, ‘no amendment to the Constitution is absolute.’

President Biden on Thursday announced a set of executive actions and legislative proposals on gun control, saying that gun violence is “a public health crisis” and the administration’s actions do not contravene Second Amendment rights.
The administration aims to “confront not just the gun crisis but what is actually a public health crisis,” Biden said in his remarks in the Rose Garden. He was joined by Vice President Harris.
“Nothing I’m about to recommend in any way impinges on the Second Amendment,” Biden said. “These are phony arguments suggesting that these are Second Amendment rights at stake from what we’re talking about.”
Continuing, Biden said: “But no amendment to the Constitution is absolute … From the very beginning, you couldn’t own any weapon you wanted to own. From the very beginning the Second Amendment existed, certain people weren’t allowed to have weapons. So the idea is just bizarre to suggest that some of the things we’re recommending are contrary to the Constitution.”

My suggestion is to restore an industrial level of Capital Punishment executions. Violent criminals–particularly the career variety–are not responsive to rehabilitation programs. Once they produce a weapon to murder people, or attack and kill helpless children or elderly victims, they should get their day in court, appeal their conviction, and if that effort is unsuccessful, then they should get the injections. (That form of execution is rather preferred. Hanging was a much more foreboding prospect for condemned and/or prospective killers.) The only people who benefit by keeping such reprobates alive are them and their lawyers/judges/bailiffs/prison officials/media.

An Amendment to the Constitution is absolute until and unless it is repealed or modified by another amendment. The new amendment must be passed using the procedures proscribed by the Constitution. A President does not have the authority to arbitrarily ignore, modify, abrogate, or cancel an amendment or any other part of the Constitution simply because he does not like it or he disagrees with it. He took an oath to uphold and defend the Constitution! To attempt to countermand any part of the Constitution without following the proper amendment procedures is to violate that oath of office. And that is grounds for impeachment!

The President does not have the authority to arbitrarily abrogate or modify any part of the Constitution. The only legitimate way an amendment or any part of the Constitution may be changed or cancelled is following proper procedures of the amendment process.

Our nation’s Founders believed that rights predated the establishment of our government. Therefore, there are no “constitutional rights”, only constitutionally protected rights. If the 2A were repealed tomorrow, it wouldn’t mean that the right to defend oneself, family, country and community was gone. As I understand it, the Constitution was NOT finally ratified until the Bill of Rights (1st 10 Amendments) had been added as demanded by the states. Hence, they are NOT “Amendments” in the normal sense but an integral part of the Constitution itself.
The Constitution is “the Supreme Law of the land”. Hence, the Bill of Rights is the “Supreme Law of the land”.
The Constitution is the contract which exists between the federal government and the People as represented by the States. The Constitution was written, as described in the Declaration of Independence, to institute a government primarily “to secure our unalienable rights”.
If Uncle Joe is saying that the federal government can unilaterally change the contract and be no longer bound by it then the States and the People must assume the same right. In short, the federal governments unilateral removal of one part of the Supreme Law of the land means that it (the federal government), rather than the Constitution has become supreme.
I’m personally unaware of any oath or obligation undertaken by American citizens or soldiers to protect and defend or pledge loyalty to the federal government. Rather, we pledge our allegiance and loyalty (as children) to the flag and to the Republic for which it stands (created by the Constitution). If the current administration feels itself due higher loyalties than those, it is seriously mistaken.
