Trump Indicted on Hush Money Charges: A New Legal Proceeding for the Ex-President

Former President Donald Trump has been indicted on charges related to a payment to adult film star Stormy Daniels in 2016. This historic development sets up a unique legal proceeding, as no sitting or former president has ever faced criminal charges.

Arraignment and Plea

Manhattan District Attorney Alvin Bragg’s office contacted Trump’s attorney to coordinate his surrender to the Manhattan DA’s Office for arraignment on a Supreme Court indictment, which remains under seal. After Trump surrenders, he will be processed privately, which means that he would likely be fingerprinted and may have a mug shot taken. During the arraignment hearing in New York, the judge will present the charges against Trump and the former president could enter a plea. Trump’s attorney, Joe Tacopina, told ABC’s “Good Morning America” on Friday that the former president “will not be put in handcuffs,” adding that Trump will plead not guilty during the upcoming arraignment hearing.

Trial and Possible Acquittal

Trump pleaded not guilty, and a trial will be required, during which the state will have to prove “beyond a reasonable doubt” that Trump is guilty of the charges. It could take several months for a trial to start, as both sides must exchange information about witnesses and evidence they plan to present in the trial as part of the discovery phase, and pre-trial hearings must also be held. Trump will be acquitted of the charges if he’s found not guilty at the end of the trial. If he’s found guilty, he’ll likely appeal the verdict. If the verdict is upheld, he’ll be sentenced, though he’ll likely also be able to appeal his sentence.

Unification of the Republican Party

Trump’s indictment has unified the Republican Party around him, as nearly every Republican in elected office has defended Trump and decried the indictment as politically motivated – with only a few prominent GOP defectors. The charges are expected more than four years after Michael Cohen, the lawyer who handled the payment for Trump, was convicted and sentenced to three years in prison. He has been a witness against the former president. After his conviction, Cohen alleged that Trump had ordered him to pay Daniels $130,000 in hush money just before the 2016 election and later reimbursed him for it through the Trump Organization as legal expenses.

Trump’s indictment marks the first time a sitting or former president has faced criminal charges.   1. So, Prez Trump is being Charge for 1 crime 34 times? No cuffs, no perp walk, no mugshot and no conviction when this is doen. Seems Jan might be the first trial exhibition, or later.
