Rep. Claudia Tenney, R-N.Y, has the support of 168 House Republicans in her petition to get the U.S. Supreme Court to overturn a state law that constrains New York residents from being allowed to carry concealed weapons in public.    

New York is one of eight states that limit their residents’ concealed carry gun rights, along with California, Delaware, Hawaii, Maryland, Massachusetts, New Jersey, and Rhode Island.

“Everyone is basically issued a restricted carry permit,” Tenney commented. “There are places in New York where [gun license requirements are] really so limiting … With more and more crime, you really can’t defend yourself.”

By the end of the month, Tenney and her Republican supporters will file an amicus brief alleging that the state law which rejects law-abiding residents from obtaining concealed-carry permits without proper cause, is a violation of their Second Amendment rights. 

The New York State Rifle & Pistol Association, which is suing the state in federal court, welcomes the congresswoman’s support of their lawsuit. 

“Everybody is very interested in it,” Tenney announced. “This would probably give some clarity on a national level as to the ability to restrict Second Amendment rights when it comes to concealed carry, particularly outside the home.”

She said that New York residents are fearful of the state’s surging crime rates, and while state Governor Andrew Cuomo blames firearms to the extent of declaring the “first-in-the-nation” disaster emergency on gun violence, Tenney thinks bail reform is the real culprit. 

“We’ve taken the toolbox away from the police,” the congresswoman said. “We’ve redefined all levels of crime. Cuomo let all kinds of people out of [prison], especially during the pandemic last year. There are new initiatives to let more and more people out of prison … So, they’re putting us in a very unsafe position, and now they’re cracking down on lawful gun owners.”

Seven out of eight New York House Republicans signed the amicus brief, along with the top three House Republicans – House Minority Leader Kevin McCarthy, Minority Whip Steve Scalise, and House Republican Conference Chair Elise Stefanik.

“This congressional brief sends a clear message that our Constitutional rights are not up for negotiation,” Tenney remarked.
