An illegal immigrant was deported by the U.S. government a whopping 15 times—but now, he’s accused of severely injuring a small boy, after a drunk driving accident.

The Lake family, of San Diego, California, was returning home from a trip to Disneyland. They were just one block for their home in the neighborhood of San Ysidro when Constantino Banda-Acosta’s car smashed into theirs. The Lakes’ six-year-old son, Lennox, sustained severe head injuries, and remains in critical care.

Banda-Acosta, 38, had been deported 15 times over the last 15 years, but it’s unclear if he was charged with a felony any of those times. He’s suspected to have crossed back into the U.S. most recently in January.

According to reports, Banda-Acosta had been drinking and driving. While speeding through the neighborhood, Banda-Acosta ran a stop sign, flew around the corner, ran into the Lakes’ Honda Accord just before midnight on Saturday. The Lakes’ car was thrown through a guardrail.

Banda-Acosta fled the scene, but a nearby Border Patrol agent was able to apprehend him. Banda-Acosta was turned over to police, and a passenger, who was also an illegal immigrant, was taken to a Border Patrol station for deportation.

Ben Lake, father of injured Lennox, explained his son’s condition: “Right now he has a lot of swelling and can’t open either of his eyes so he’s scared about why he can’t see.”

“I just really care about bringing him home and making sure he’s happy again,” he said, fighting back tears.
