A murderer who got a shortened sentence because a judge felt he was too old to kill again is back again, convicted last week of stabbing a woman to death.
Albert Flick, 77, was found guilty of stabbing 44-year-old Kimberly Dobbie to death in front of a Lewiston, Maine laundromat.
Her twin 11-year-old sons were just feet away as Flick stabbed her 11 times.
Flick was allegedly obsessed with Dobbie and stalked her before the murder.
He previously served three prison sentences for attacks on women, two of them stabbings, with his third prison stint shortened by a judge who felt he was too old to stab another woman.
Flick served 25 years of a 30-year sentence for the 1997 murder of his wife. He stabbed her 15 times as their 12-year-old daughter watched.
He was released in 2000 but sent back for stabbing a woman with a fork.
He was released again in 2004 but was arrested and convicted again in 2010 for assaulting another women.
Citing his record of repeatedly stabbing women, prosecutors recommended a sentence of eight to nine years, but Maine Superior Court Justice Robert E. Crowley gave Flick a shorter sentence of only four years, ruling “At some point, Mr. Flick is going to age out of his capacity to engage in this conduct, and incarcerating him beyond the time that he ages out doesn’t seem to me to make good sense from a criminological or fiscal perspective.”
In other words, the judge felt that despite going to prison three times for attacking women, two of them stabbings, a then-68-year-old Flick would “grow out” of stabbing women.
He didn’t.
“I don’t understand how somebody that is obviously such a threat to society was back on the streets,” Flick’s daughter, Elsie Clement, who witnessed the first murder, told WCSH. “I don’t understand. I can’t for the life of me wrap my head around it. I can’t.”
Crowley is now retired and did not respond to NBC News’ request for comment.
Dobbie’s sons now live with their grandmother in Massachusetts.
Flick will be sentenced in January to his fourth prison term. The murder charge carried a minimum sentence of 25 years, but prosecutors will ask for a life term.
