Senator Ted Cruz shredded the Democrats’ new push for new red flag laws, claiming that they were merely a stalking horse for comprehensive gun control.

Red flag laws are designed to attempt to prevent domestic abusers from obtaining firearms.

As The Daily Wire reports:

Texas Sen. Ted Cruz (R) on Wednesday slammed the Democrats’ push for Extreme Risk Protection Orders (ERPOs), commonly referred to as “Red Flag laws.” According to the senator, Red Flag laws lack due process for a constitutionally protected right and are proven to be ineffective in stopping mass shootings and suicides.

“I care deeply about stopping violent crime. And gun crime in particular. I’ve spent much of my adult life in law enforcement trying to stop violent criminals who prey upon the innocent and working to ensure that they receive the most stringent punishment,” Cruz said during a Senate Judiciary Committee hearing on Red Flag laws. “But one thing is abundantly clear: if the objective is to stop violent crime, restricting the rights of law-abiding citizens doesn’t work. In fact, it typically makes crime worse because when you disarm law-abiding citizens you make them more likely to be victims.”

The senator has repeatedly said Red Flag laws are dangerous but believes states should look at this legislation on an individual basis.

“[States] are the proper place to debate the substance of Red Flag laws. We shouldn’t be imposing a federal standard or putting the federal government’s very heavy thumb on the scale with coercive grant programs, especially when 19 states and the District of Columbia are already experimenting with these laws. But I also said, and continue to believe, that even at the state level, laws must be narrowly targeted to those who pose an extreme risk while simultaneously giving full force to the fundamental rights of all law-abiding Americans,” he explained. “Many of the state laws that have been implemented fall short of this standard in one or more ways, and none of the Democrats’ current proposals come close to meeting it. Rather than taking a measured and respectful approach, radical gun control advocates see Red Flag laws as a way to open the door to comprehensive gun control.”

  1. With the abuses we’ve seen from the DOJ/FBI/NSA targeting conservatives, this would be the ruse to disarm political opposition voices. They’ve already labeled the conservatives Domestic Terrorists, while the likes of BLM, Antifa and MS-13 are running free & wild under the protection of the current administration and the state Lib/Prog/Socialist Soros DAs!

They we’re armed with slingshots. We’re also neglecting to mention that those same “Anti-Gun” (See “Anti-Constitution) zealots are getting us into wars, while they release violent criminals out of jails, or wave them across our borders. Disarming the American people is an act of tyranny, and the more we allow the media/government amalgamation to campaign against our 2nd Amendment, the less freedom we will retain against those tyrants.

  3. The red flag laws typically deprive people of their unalienable right to defend themselves without their having committed any crime. We don’t live in the world depicted in the movie “Minority Report” (YET!). Two the most basic and fundamental premises underlying our entire judicial system are that one is presumed innocent until proven guilty in court, and that one must be convicted of actually committing a crime before being punished for it. Depriving someone of the ability to defend himself effectively is unquestionably punishment and deprivation of his rights. Such red flag laws are utterly immoral and unconstitutional on their face and should be treated as such.

    1. Ted Cruz is a very good attorney as well as Senator. Biden’s administration needs to be sued repeatedly on his executive orders, Constitution violations, and more. Clog the courts with lawsuits against all of Biden’s crap, clog the courts, and demand the courts issue injunctions and orders….

With the domestic abuse that is going on, the killing of children going on, the abuse to the pets going on, drive by killings, and all the other gun crimes happening; We need a universal background check with mental illness testing in there. When parents call in that their child has a gun and is dangerous; it has to be believed. We even had judges homes attacked and their families killed. My Uncle was a judge and he told me of many of his cases. this does NOT change the 2nd amendment. If you havenothing to hide and are sane, you can geet a gun. You don’t need a weapon of war and a stockpile of ammo. Many who get restrictions against the spouse or partner, end up getting killed because they think if I can’t have them no one can. they can get a gun that can shoot a distance. This has gone to far and those who really object in Congress have their campaigns bought for by the NRA. One of the biggest contributors of the Rep. party. And they are under scrutiny and legal cases and bankrupcty right now.

      1. Capital punishment is needed for thugs and killers who abuse the Second Amendment by killing others. We put out garbage in our homes; this killer garbage needs to be put down permanently. Capital punishment preserves the INTEGRITY of the Second Amendment. Prior to 1960, it was easy to get a capital sentance for a convicted killer. Since 1960, killers have been coddled by the courts and legislatures. The Second Amendment specifies the right to bear arms “shall not be infringed”. Garbage smells, the country needs to get rid of it, including thugs and killers. Permanently.

    2. Criminals, crazies and terrorists don’t follow laws, or submit to background checks. No matter what state you live in. The states, and cities, with the most restrictive (unconstitutional) gun laws have the most crime. Do you think that is a coincidence?

    3. Yeah, and when your neighbor doesn’t like you, or an ex decides to get a little easy revenge, they make an anonymous phone call and a SWAT team bursts into your home to seize anything that they deem as a danger to yourself and/or others………

  5. So, if the government is allowed to confiscate a person’s guns without due process just because the person might harm himself/herself or others then what’s to stop them from confiscating knives from people, or their car keys, or their cars without due process?

    Red flag laws are/should be illegal because they do an end run around the due process clause.

Way to go Ted.If they want to curb violent crime then go after the criminals that are committing these crimes.Take them off the streets permanently and stop just slapping them on the hand and letting them go.I have never seen a gun laying on a table or standing in a gun safe get up and shoot anyone on its own.It takes a person behind that gun to do the crime.The only reason the damn democrats want to impose gun laws is nit to stop violent crime but to disarm law abiding citizens so they can do whatever they want to do to them and not have to worry about the citizen being able to defend themselves.You can bet your ass they will have their body guards armed to protect them.Disarm their body guards and see how they like it.Owning a gun is nit a privilege but a right given to us by the Constitution and it shall not be infringed upon.Address the real problem and that is the criminal not the gun or anything the criminal wants to us to commit the violent crimes.

  9. Trying to figure out what part of “shall not be infringed” they are having trouble with. Is infringed too big of a word?what about the phrase “shall not”? I have a dictionary I will donate to congress if that will help!

  11. Actually, Senator Cruz, the federal government, especially the DOJ, should be making absolutely certain that states do NOT infringe on the rights of Americans, as per the 14th Amendment. Constitutional scholar, Krissanne Hall, makes the incredibly apt argument that the Constitution is a contract between the government and the people. This is why it can not be unilaterally altered by one side but only through the amendment process. I would go a step further and suggest that it is the very foundation upon which our country is built and, while I may not be a constitutional professor like Obama, I have seen what happens when a foundation is eroded………………………..the house soon comes down and people often die in the collapse.
