A Manhattan judge ruled authorities violated Michael Cohen’s First Amendment rights when they hauled the former Trump attorney back to prison on July 9.

After Cohen balked at signing a form barring him from speaking to the press or publishing a book about Trump before the November election, probation officers sent the president’s onetime so-called fixer back to prison.

But after a little more than two weeks, he will be re-released.

The Week reports:

Cohen, who pleaded guilty in 2018 to tax fraud, campaign finance violations, and lying to Congress, was released into home confinement in May but was ordered back to prison in July. His lawyers subsequently filed a lawsuit alleging the Department of Justice was retaliating against him over a book he was planning to publish about Trump, saying not releasing a book was one of the conditions in an agreement he was asked to sign. Assistant U.S. Attorney Allison Rovner, meanwhile, said Cohen was arrested “because he was antagonistic during a meeting with probation officers,” also saying the probation officer wrote the agreement wasn’t aware of Cohen’s planned book.

But on Thursday, the judge sided with Cohen and said the “purpose” of sending him back to jail “is retaliatory and it’s retaliatory because of his desire to exercise his First Amendment rights to publish a book and to discuss anything about the book or anything else he wants on social media and with others,” The Washington Post reports. Cohen is now set to be released by Friday afternoon.

  2. House arrest for tax fraud, campaign finance violations, and lying to Congress? Why wasn’t he serving the prison sentence he was given? Where are all the leftists whining about that lke they are Roger Stone? Violating Cohen’s 1st Amendment rights? Seems to me Cohen was violating the generous house arrest and needs to be back in prison, not walking the streets.

  3. He was released to house arrest which means you stay in “your house”. He went to a restaurant for dinner with wife and friends and was breaking his release protocol. Back to the slammer…what part of law doesn’t this judge understand.

    1. I guess that would be the part where a person is guilty of NOTHING but gets trapped by evil bureaucrats who seek charges where there is NO CRIME.
      Like where they demand Trump’s tax returns where they have NO EVIDENCE of wrong doing but are on a witch hunt.
      And this has been going on for 3 and a half years.
      I don’t care for the courser parts of Trump. But frankly, he has been the best president in TWO CENTURIES.
