Five police officers sued central California city Palo Alto for allowing an “offensive” Black Lives Matter mural with anti-police imagery to be created and displayed across from City Hall.
“Law enforcement officers, including Plaintiffs, were forced to physically pass and confront the Mural and its offensive, discriminatory, and harassing iconography every time they entered the Palo Alto Police Department,” the lawsuit said.
Following the murder of George Floyd and the civil unrest that erupted across the nation, the 245-food long mural was authorized by the City Council on June 15, 2020, and activists painted the mural in the street over the next two weeks.
The mural spelled out Black Lives Matter, and featured multiple images within each letter, including the New Black Panthers logo, which has been identified as a hate group that encourages violence against police.
The lawsuit notes that an image of Assata Shakur, who was convicted of murdering New Jersey State Trooper Wermer Foerster in 1977, is prominently featured in the letter “E” on the mural. Shakur escaped from prison and fled to Cuba, where she is suspected to still be residing.

The plaintiffs allege that the mural is a violation of the state’s Fair Employment and Housing Act, and despite the National Police Association calling for the artwork to be removed upon its completion in July, the city allowed it to remain up until November 2020.
“Defendants created and allowed to exist the aforementioned discriminatory and harassing work environment,” the suit claims. “Not only did the defendants allow the harassing and discriminatory iconography to exist in the workplace, but they also sanctioned, approved, encouraged, and paid for it.”
