A total of Twenty Republican state attorney generals released a statement directed toward Walgreens and CVS for their plan to distribute pills that would induce an abortion through the mail, with Missouri AG Andrew Bailey stating that this would violate both state and federal laws.

Missouri AG Andrew Bailey said in a statement that his office intends to “every tool at our disposal to uphold the law.” adding, “As Attorney General, it is my responsibility to enforce the laws as written, and that includes enforcing the very laws that protect Missouri’s women and unborn children.”

“[M[any people are not aware that federal law expressly prohibits using the mail to send or receive any drug that will ‘be used or applied for producing abortion,’”

“Although many people are unfamiliar with this statute because it has not been amended in a few decades, the text could not be clearer: ‘every article or thing designed, adapted, or intended for producing abortion … shall not be conveyed in the mails.’ And anyone who ‘knowingly takes any such thing from the mails for the purpose of circulating’ is guilty of a federal crime,”

While the White House intends to change the Food and Drug Administration (FDA) rule after Roe v Wade was overturned to allow pharmacies to distribute two-step abortion drugs; Mifepristone, the first of the two pills used in the two-step abortion pill system had prior legislation allowing the pill to only be distributed by a handful of online pharmacies.

However, Missouri AG Andrew Bailey has since issued a statement for the Biden administration as well, saying:

“We reject the Biden administration’s bizarre interpretation, and we expect courts will as well. Courts do not lightly ignore the plain text of statutes. And the Supreme Court has been openly aversive to other attempts by the Biden administration to press antitextual arguments,”

“A future U.S. Attorney General will almost certainly reject the Biden administration’s results-oriented, strained reading. And consequences for accepting the Biden administration’s reading could come far sooner,”

The AG office also points out that similar to federal law, “the laws of many states also prohibit using the mail to send or receive abortion drugs.”

Whether or not the Biden administration does manage to change the procedure around abortion legislation, the twenty Republican Attorney Generals intend on fighting pharmacy’s ability to ship abortion drugs tooth and nail following the overturning of Roe v Wade.
